INTELLECTUAL PROPERTY RIGHTS PROTECTION POLICY:
By initiating an order with Music on the Run (MOTR/Disc Makers) the customer represents and warrants that they are the true and rightful owner of, or have licensed or otherwise possess the legal, enforceable right to reproduce, manufacture or use the product and/or materials provided to MOTR/Disc Makers by customer. MOTR/Disc Makers, in good faith, shall rely solely and totally on the client’s representation and warranties as provided by the client. In this regard, customer agrees to indemnify, defend, protect and hold harmless MOTR and Disc Makers against any and all liability, losses, claims, damages, lawsuits, causes of action including any and all costs and expenses, attorney’s fees suffered, or incurred, directly or indirectly, by a third party/parties (as well as any and all legal fees that may have been sustained by MOTR/Disc Makers), based on the assertion that the services provided to the customer under this agreement breaches the patent, copyright, trademark, trade secret or any other proprietary right or violation or any intellectual property rights of such third parties.

MOTR/Disc Makers reserves the right to decline duplication or replication of any order.

TERMS: All orders must be paid in full at time of ordering. MOTR/Disc Makers accepts cash, Visa, Mastercard, Discover and American Express.

DELIVERY: Every attempt will be made to meet your production schedule, however, we cannot guarantee an exact pick up or shipping date nor do we assume any liability should we not meet an anticipated delivery date.

CANCELLATIONS: If the order is cancelled for any reason, client is responsible for payment of all services rendered.

MERCHANDISE RETURNS: All claims for defective merchandise must be made within 48 hours of pick up or shipping date.

WARRANTY: MOTR/Disc Maker’s warranty is limited, at our option, to reduplication, reprinting or refunding of monies paid for services rendered. We are not responsible for any consequential cost or damages incurred, including shipping charges. MOTR/Disc Makers warrants that duplicated copies will perform properly on our test equipment. We cannot guarantee that CD-Rs and DVD-Rs will be universally compatible with all playback devices.

SALES TAX: All MOTR/Disc Makers products shipped to or picked up in the following states, NY, NJ, MA, VA, GA, Il, TN, TX, WA, CA and Puerto Rico are subject to sales tax. Sales tax must be charged unless the appropriate tax exemption certificate is submitted.

ALL TRANSFERS ARE MADE 1:1 FROM CLIENT’S SUPPLIED MASTER: Music on the Run/Disc Makers is not responsible for any sound anomalies on the copies made if these anomalies are on the client’s supplied source master. Level adjustments, sequencing, editing, and equalization services are available for an additional charge.

STORAGE: Music on the Run/Disc Makers will make every attempt to keep a copy of the digital files used in the duplication and printing of your product for a period of 90 days from your order date; however under no circumstances shall we be liable in anyway should these files become lost, erased, corrupted or in any way unusable.
